1. Scope
These General Terms and Conditions apply to all orders placed by customers via the online shop of Agosti Trade GmbH, Haldenstrasse 62, 9200 Gossau, info@salebrus.com (hereinafter referred to as SALEBRUS).
2.1 Shopping at SALEBRUS is only permitted for customers who have registered properly and truthfully.
2.2 The creation of multiple accounts and their use by the same person is strictly prohibited.
2.3 Furthermore, any commercial or business use for the purpose of reselling goods to third parties is prohibited.
2.4 Violations may lead to immediate exclusion and claims for damages by SALEBRUS. SALEBRUS may also restrict the maximum delivery quantity per item and customer.
3.1 The presentation of the products in the online shop does not constitute a legally binding offer, but rather an invitation to place an order.
3.2 By clicking the “Order with obligation to pay” button in the shopping cart, the customer submits a binding offer.
3.3 The automatically generated confirmation email documents receipt of the order. The binding contractual relationship only comes into effect when SALEBRUS confirms the shipment of the goods by email (shipping confirmation), but at the latest upon delivery of the goods.
3.4 If SALEBRUS discovers during order processing that the products ordered by the customer are unavailable, the customer will be informed by email. No contract will be formed for the unavailable goods.
4.1 The prices listed in the SALEBRUS online shop at the time of ordering apply. The prices shown are gross prices including statutory VAT.
4.2 Packaging and shipping costs are added to every order placed with SALEBRUS. The actual invoice amount depends on the delivery method and payment method. The exact shipping costs are displayed to the customer during the ordering process. In exceptional cases and special promotions, shipping may be waived.
5.1 Delivery is worldwide.
5.2 For items in stock, the delivery time is 2-5 working days.
5.3 If delivery of the goods fails due to the customer’s fault, SALEBRUS may withdraw from the contract. Any payments already made will be refunded immediately.
6.1 Payment can be made by invoice (only available in Switzerland), credit card, Apple Pay, PayPal, or direct bank transfer. All credit card payments are processed via Stripe. The data is encrypted and transmitted to Stripe for processing.
6.2 SALEBRUS may cancel or suspend an order if
(a) a customer is not creditworthy or appears to be
(b) has more than one outstanding reminder or
(c) there is reasonable suspicion of dishonest intentions.
7.1 You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods. You may use the model withdrawal form attached to the shipment, but it is not obligatory. To exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or email). You may use the attached model withdrawal form, but it is not obligatory. To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
CONSEQUENCES OF WITHDRAWAL
If you withdraw from this contract, we will reimburse all payments received from you, including any delivery charges, without undue delay and in any event no later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will use the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest. You must return or hand over the goods to us at the address above without undue delay and in any event no later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired.
Only items that are completely undamaged and in perfect, unworn condition will be accepted for return. In particular, worn, soiled, damaged, or malodorous products cannot be returned. Should this not be the case, we reserve the right to claim compensation.

7.2 The right of return is excluded for the following products:
– Items from special promotions (e.g., sales, special offers)
– Items marked “this item cannot be returned”
If the above-mentioned products are defective, incomplete, or in poor condition, they can be returned. In this case, SALEBRUS will endeavor to provide an equivalent replacement. If this is not possible, the money already paid will be refunded.
7.3 Credits for returned goods will be issued to the SALEBRUS account of the customer concerned. Exception: Orders that have already been paid for in advance by credit card will be refunded to the credit card.
7.4 In the case of abusive orders (e.g., ordering different sizes of an item to try on), SALEBRUS reserves the right to refuse the return.
The goods remain the property of SALEBRUS until full payment has been received.
9.1 The promotional vouchers can only be redeemed if the minimum order value specified on the voucher has been reached.
9.2 Combining multiple promotional vouchers is not permitted.
9.3 The promotional vouchers are valid until the specified date.
9.4 It is not permitted to transfer promotional vouchers to third parties.
9.5 Promotional vouchers cannot be applied retroactively to an order.
9.6 The balance of a promotional voucher cannot be paid out in cash or accrue interest.
10.1 SALEBRUS only stores data that is necessary for customer service. SALEBRUS adheres to the code of ethics of the Swiss Mail Order Association (VSV).
10.2 To create a customer account, the customer is asked to provide personal data. This includes first name, last name, email address, and address. Information marked with an asterisk is required for processing orders. Providing further personal data is voluntary and serves to profile the customer. SALEBRUS uses this data for data processing, managing customer accounts, and for marketing purposes, such as sending personalized newsletters if the customer wishes to receive them.
10.3 SALEBRUS uses cookies. However, these are only used to save customer transactions and thus simplify future visits and purchases. Cookie settings can be managed in your browser’s security settings.
10.4 SALEBRUS uses Google Analytics to analyze website usage. This generates anonymized reports and charts. Google Analytics is used solely for internal market research and anonymized remarketing measures to optimally adapt the website design to customer needs.
10.5 No personal data will be disclosed to third parties without the customer’s knowledge. However, if we provide services in advance, e.g., in the case of a purchase on account, we may, to protect our legitimate interests, obtain a credit report from a credit agency based on mathematical-statistical methods. For this purpose, we transmit the personal data required for a credit check to a credit agency and use the information received about the statistical probability of payment default to make a balanced decision regarding the establishment, execution, or termination of the contractual relationship. We will gladly inform you upon request which credit agencies we contact for this purpose.
10.6 User data can be changed at any time under “Your Account” – “Personal Settings”. The address can be changed under “Your Account” – “Addresses”.
10.7 The information we receive from you helps us to continuously improve your shopping experience and make it more customer-friendly and personalized. The information you provide and the information automatically generated is used to create advertising tailored to you and your interests. For this purpose, we use existing information such as email read receipts, information about your computer and internet connection, operating system and platform, your order history, your service history, the date and time of your website visit, and the products you viewed. We use this information exclusively in pseudonymized form. By analyzing and evaluating this information, we can improve our website and online services and send you personalized advertising. This means advertising that recommends products that might actually interest you. Our goal is to make our advertising more useful and interesting for you. Therefore, the evaluation and analysis of the pseudonymized data we collect from you helps us ensure that we don’t send you random advertising. Rather, we send you advertising, such as newsletters and product recommendations, via email or postal mail that matches your interests. For example, we also track which of our promotional emails you open to avoid sending you unnecessary emails.
